Please read these terms and conditions (Terms) carefully, as they set out our and your legal rights and obligations in relation our CAIA application offered by CAIAGLOBAL GmbH. You will be asked to agree to these Terms before becoming a customer or using our application.

You should print a copy of these terms and conditions for future reference. We will not file a copy specifically in relation to you, and they may not be accessible on our website in future.

These Terms govern your use of the websites that link to these Terms. In these Terms, the word “Sites” refers to each of these websites and the services offered on those Sites. You automatically agree to these Terms and to our Privacy Statement simply by using or logging into the Sites.

In order to enter into the Terms, you must take the following steps:

  • you must select the Application from the Providers website;

  • you must then start the payment via credit card;

  • after the successful payment we will generate an account for you promptly and you get access to your account for the period which was paid;

  • once you are logged in, you must consent to the Terms.

 

 

A. Provider, Us

 

Provider means CAIAGLOBAL GmbH - Cognitive Artificial Intelligence Application Global Limited Liability Company listed in the Commercial Register of the Munich District Court under Commercial Register Number HRB 240158.

B. Your Accounts

 

Depending on the service, you choose you may be required to create an account and specify a password in order to use certain services or features on the Sites. To create an account, you must be at least 18 years old and you must provide truthful and accurate information about yourself. Don’t try to impersonate anyone else when you create your account. If your information changes at any time, please update your account to reflect those changes.

In some cases, an administrator, such as your employer, may assign an account to you. If you are using or logging into an account assigned to you by an administrator, additional terms may apply to your use of the Sites. Moreover, your administrator may be able to access or disable your account without our involvement.

You may not share your account with anyone else. Please keep your password confidential, and try not to use it on other websites. If you believe that your account has been compromised at any time, please notify your system administrator.

On your Dashboard, you can see a summary of the uploaded resumes, jobs, interviews that have been done already plus the number of active users/recruiters.

 

Adding your first job

To open a new job role/position you need the same data that you would expect from a standard job advertisement, no extra efforts needed.

Step 1. Fill up the Job title, Company Name. To make things easier you can choose a predefined Job role from the drop-down menu.

Step 2. Add a short company description, salary limit and start date.

Step 3. Add keywords (e.g. Java skills), required languages, degree, certificates, or you can choose experience band from the drop-down menu.

Final step. Copy the CAIA application URL into your advert and you’re ready to start your search.

You can follow your open positions in the Job list.

 

Application process

The candidate receives the job information via the CAIA Apply URL.

On the same page, the Candidate can sign up easily with some basic data, including uploading their CV.

CAIA performs the scoring process of the CV in seconds and sends the candidate an automatic interview invitation (URL) via e-mail.

By comparison, CV scoring for an experienced HR department usually takes around 30 minutes, with CAIA, it’s done in 1 second.

 

See who you’re interviewing

Stay up to date with all your candidates in our easy to use ‘Candidates List’, featuring scores and analytics for each applicant.

You can check the Name, Email, Phone, Location, Job title and progress percentage status for all your candidates. Of course, you can dig deeper for more information by clicking on the selected candidate.

 

The Interview

After the candidate receives their automatic interview invitation (URL) via e-mail, the candidate can hold the interview with CAIA anytime. It is available for the candidates 24/7 all around the world. No human intervention is required.

HR or the responsible person for Hiring can read the whole interview any time; however, the scoring of the interview will be done by CAIA in a matter of seconds.

Results process

To check the results of the interview, click on your ‘Candidate List’ the details are available at any time for you to check, or refer back to.

Review the updated status of candidates following a successful interview. View the scorecard and personality test and with the whole interview. No human effort required.

Under the tab Summary, you will find the highlighted points of the CV.

Check the applicants ranking via their ‘score’ in an overview chart.

Under the tab Personality, you can see diagrams about BIG5, confidence level, positivity or personality traits. You will get a SLOAN textual evaluation as well.

In the Interview section, you will find the complete interview made by CAIA with your candidate.

In the ‘History’ tab you can check the timeline of the hiring process.

 

Final candidates

You now have a curated shortlist of candidates with all the details prepared for the HR or recruitment decision-makers.

CIAA has helped to reduce the workload, providing only the best candidates for the job - allowing you to spend more time with the right people for the job.

 

D. Modifications and Termination

 

We reserve the right to modify our Sites at any time, with or without notice to you. For example, we may add or remove functionality or features, and we may suspend or stop a particular feature altogether. We also reserve the right to charge a fee for any of our features at any time. If you don’t like any changes, you can stop using our Sites at any time.

 

E. Your Use of the Sites

 

Please do not use the Sites in a way that violates any laws, infringes on anyone’s rights, is offensive, or interferes with the Sites or any features on the Sites (including any technological measures we employ to enforce these Terms).

It should be common sense, so we won’t bore you with a list of things you shouldn’t do. But if we (in our sole discretion) determine that you have acted inappropriately, we reserve the right to take down Content, terminate your account, prohibit you from using the Sites, and take appropriate legal actions.

Using our Site does not give you ownership of any intellectual property rights to the content you access. You may not use content from our Sites unless you obtain permission from us or its owner, or unless you are otherwise permitted by law.

 

F. Intellectual Property Rights

 

Intellectual Property Rights means all intellectual property rights wherever in the world, whether registered or unregistered, including any application or right of application for such rights (and the “intellectual property rights” referred to above include copyright and related rights, database rights, confidential information, trade secrets, know-how, business names, trade names, trademarks, service marks, passing off rights, unfair competition rights, patents, petty patents, utility models, semi-conductor topography rights and rights in designs).

All Intellectual Property Rights in the Platform shall, as between the parties, be the exclusive property of the Provider.

 

 

G. Our Warranties and Disclaimers

 

We provide our Services using a commercially reasonable level of care and promise to do our best to make sure you enjoy the Services. But there are certain things that we don’t promise about our Services.

Other than as expressly set out in these terms of service, neither CAIAGLOBAL GmbH, inc. nor its agents or service providers (the “services entities”) make any specific promises about the sites. For example, we don’t make any commitments about the content within the sites, the specific function of the sites, or their reliability, availability, or ability to meet your needs. We provide the sites “as is”.

Some jurisdictions provide for certain warranties, like the implied warranty of merchantability, fitness for a particular purpose, and non-infringement. To the extent permitted by law, we exclude all warranties.

 

H. Liability for our Services

 

Except where prohibited, the services entities shall not be liable for any indirect, special, incidental, consequential, or exemplary damages arising from your use of the sites or any third party’s use of the sites. These exclusions include, without limitation, damages for lost profits, lost data, computer failure, or the violation of your rights by any third party, even if the services entities have been advised of the possibility thereof and regardless of the legal or equitable theory upon which the claim is based.

 

I. Force Majeure Event

 

Force Majeure Event means an event, or a series of related events, that is outside the reasonable control of the party affected (including failures of or problems with the internet or a part of the internet, hacker attacks, virus or other malicious software attacks or infections, power failures, industrial disputes affecting any third party, changes to the law, disasters, explosions, fires, floods, riots, terrorist attacks and wars).

 

 

J. Privacy policy

Principles

Article 5

Principles relating to processing of personal data

1.   Personal data shall be:

(a)

processed lawfully, fairly and in a transparent manner in relation to the data subject (‘lawfulness, fairness and transparency’);

 

(b)

collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes; further processing for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes shall, in accordance with Article 89(1), not be considered to be incompatible with the initial purposes (‘purpose limitation’);

 

(c)

adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed (‘data minimisation’);

 

(d)

accurate and, where necessary, kept up to date; every reasonable step must be taken to ensure that personal data that are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay (‘accuracy’);

 

(e)

kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed; personal data may be stored for longer periods insofar as the personal data will be processed solely for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes in accordance with Article 89(1) subject to implementation of the appropriate technical and organisational measures required by this Regulation in order to safeguard the rights and freedoms of the data subject (‘storage limitation’);

 

(f)

processed in a manner that ensures appropriate security of the personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organisational measures (‘integrity and confidentiality’).

The service of CAIAGLOBAL GmbH – Cognitive Artificial Intelligence Application Global Gesellschaft mit beschränkter Haftung (abbreviated corporate name: CAIAGLOBAL GmbH, seat: Lerchenstr. 8. 85232 Bergkirchen, Germany, company registration number: HRB 240158) CAIAGLOBAL GmbH is aimed at supporting you to find the position you would like to have as employee. 

During its service, CAIAGLOBAL GmbH pays special attention to observe the inherent rights of the applicants in the course of the data handling, especially their informational self-determination right in line with the relevant international, European Union and domestic legal regulations.

CAIAGLOBAL GmbH collects and handles personal data electronically. In order that you can decide in the possession of adequate information on whether consenting to the collection, registration, recording, utilization, and transfer of your personal data implemented during availing the services of CAIAGLOBAL GmbH, please, read the following information on data handling that CAIAGLOBAL GmbH acknowledges as mandatory on itself.

Upon giving your personal data, you authorize CAIAGLOBAL GmbH to use the data given by you in line with this data protection declaration until the withdrawal of your consent for the purpose related to the services provided via the website. We manage your personal data in connection with your application to job advertisement, during which CAIAGLOBAL GmbH will handle your data in either of the following methods based on your choice:

-      by means of data in community site profiles;

Upon providing the data of community site profiles to CAIAGLOBAL GmbH, this declaration and the data protection policy of the respective community site shall be applicable in accordance with the policies currently provided on the respective community site. 

Personal data provided by you:

Personal data need to be given for the sake of the job application. The provision of the specified data and uploading or sending a resume are inevitable for availing the services of CAIAGLOBAL GmbH, therefore, they need to be given in each case.

During the registration and the provision of its services, CAIAGLOBAL GmbH does not request you to give special personal data. In case you provide special personal data (e.g. data related to health status, racial origin, religious or philosophical beliefs or trade union membership), CAIAGLOBAL GmbH will regard it as express written consent to handling special personal data required by the Privacy Act. 

Data handled upon visiting the homepage of CAIAGLOBAL GmbH

For the correct operation of the homepage of CAIAGLOBAL GmbH and the correct operation of the services, the use of cookies may be required. In such a case, if cookies are enabled in your browser, the use of cookies is automatic. The cookies that are saved by the browser onto your computer do not contain personal data, they may contain only bits of information that can be used by the website CAIAGLOBAL GmbH the purpose of which is that the website of CAIAGLOBAL GmbH can identify the visitor so that you as a visitor returning back do not need to give certain data already given and registered. 2. Legal ground of the data handling

Your consent constitutes the legal ground of the data handling

Pursuant to the provisions of the Privacy Act, as the personal data are recorded upon your consent, your personal data may be handled by CAIAGLOBAL GmbH for the purpose of performing legal obligations related to itself, as well as for the purpose of enforcing lawful interest of CAIAGLOBAL GmbH or third party (if the enforcement of such interest is proportionate with the limitation of the right to protection of personal data) without your further consent and even after the withdrawal of your consent. 

Your consent is the legal ground for CAIAGLOBAL GmbH transfers your personal data to partners/agents/principals in contractual relationship with CAIAGLOBAL GmbH – including to entities abroad – for the sake that job opportunity is offered to you taking into consideration those set forth in Section 1 of this declaration.

Your personal data may be used for statistical purposes – in a format that is inappropriate for identification –as well as may be handed over for statistical-purpose usage without your consent.

 

3. The purpose of the data handling

In case of data transfer, the personal data may be known by the colleagues of the partners who contribute in the implementation of the goals of the data transfer.

You are entitled to limit or to prohibit that CAIAGLOBAL GmbH uses, records your personal data you have given on the website of CAIAGLOBAL GmbH You are entitled to request CAIAGLOBAL GmbH to delete your personal data. CAIAGLOBAL GmbH shall ensure the safety of the handled data and, for this end, shall do all due and reasonable technical and organizational measures. In case of data transfer, CAIAGLOBAL GmbH shall demand its partner that it provides the adequate safety level of the data handling and that it handles data exclusively for the purpose specified during the data transfer. CAIAGLOBAL GmbH shall ensure that all its colleagues become familiar with those set forth in this information, and that they fully observe them during their work.

In certain cases (e.g. handling of security incidents, averting technical defect), CAIAGLOBAL GmbH is entitled to monitor the traffic in its own system but may use such data only for the original purpose (e.g. hindering of computer hacking, troubleshooting). For statistical and safety reasons, CAIAGLOBAL GmbH may regularly log information related to the data traffic of users but may use this information registered in the log file also for the realization of the original purpose. CAIAGLOBAL GmbH shall not undertake liability for saving data by authorized persons, whereas shall not allow and shall hinder by all means unauthorized data download. 

CAIAGLOBAL GmbH shall do all reasonable measures for the sake of the security and protection of the information. CAIAGLOBAL GmbH shall do all due safety measures in order to ensure the protection of those involved with special regard against unauthorized access, modification, forwarding, publication, deletion or destroy, as well as incidental destruction and damage. With their registration, however, the users of the website acknowledge that the protection of data cannot be fully guaranteed on the Internet. Based on all these, CAIAGLOBAL GmbH shall not be liable for occurrent unauthorized access or data cognition, as well as damage originating therefrom.

7. The accuracy and authenticity of the data handling

CAIAGLOBAL GmbH pays increased attention to that the personal data handled are up-to-date, accurate and authentic. For this purpose, CAIAGLOBAL GmbH enables you to download or delete your personal data handled any time. 

The access to, as well as the modification of the data given by you shall in each case be free of charge.

8. Rights entitling you in relation to the data handling

You may exercise claim enforcement possibilities stipulated in the Privacy Act in relation to the handling of your personal data in accordance with the rules specified in the Privacy Act.

You may request information on the handling of your personal data from CAIAGLOBAL GmbH any time via registered or registered return receipt requested mail, or e-mail sent to the e-mail address info@caiaglobal.com. Request of information sent via e-mail shall be regarded as authentic by CAIAGLOBAL GmbH only if sent from the e-mail address of the user given earlier. 

During the entire term of the data management, CAIAGLOBAL GmbH enables that you prohibit the data handling for any above purpose either registered or registered return receipt requested mail, or e-mail sent to the email address info@caiaglobal.com. In such a case, CAIAGLOBAL GmbH executes the data deletion immediately. You acknowledge that, if you request the deletion of such data that are necessary for the services provided via the website (e.g. name, address), CAIAGLOBAL GmbH will be unable to provide the services further towards the given person and, therefore, may cease his registration on the website.

You shall furthermore be entitled to protest against the handling of the personal data. In case you disagree with the decision of CAIAGLOBAL GmbH made based on your protest, you may turn to court for legal remedy.

10. Modification of the Data Protection Declaration

CAIAGLOBAL GmbH reserves the right to modify unilaterally those set forth in this information any time, of which it shall publish announcement on its website.

11. Acceptance of the Data Protection Declaration

Upon the acceptance of this information (both in the event of data registration implemented by yourself, and in the event of providing your data on community sites) you explicitly consent to that CAIAGLOBAL GmbH handles your personal data in accordance with the rules set forth in this information for the purposes specified, and that CAIAGLOBAL GmbH transfers the personal data handled for this purpose towards its partners – who cannot be specified in each case. You furthermore represent that this voluntary and definite declaration of your will is based on adequate information. During your application at CAIAGLOBAL GmbH, you also decide on the acceptance of this information, to which we call your attention in the course of the application, and which you explicitly acknowledge together with and by executing the declaration related to the application.

 

GDPR amendment to CAIAGLOBAL Privacy Policy

CAIAGLOBAL (CAIAGLOBAL GmbH – Cognitive Artificial Intelligence Application Global Gesellschaft mit beschränkter Haftung (abbreviated corporate name: CAIAGLOBAL GmbH, seat: Lerchenstr. 8. 85232 Bergkirchen, Germany, company registration number: HRB 240158) is providing AI-based HR applications basically via web and web chat interface helping the recruiting process between job candidates and hiring companies.

When you apply for a job through our CAIAGLOBAL HR applications or other means we will ask you to agree to the Policy and thereby give consent to the processing of your personal information.

 

By using the services of CAIAGLOBAL you explicitly accept, without limitation or qualification, the collection, use, and transfer of personal information provided by you in the manner described in this Policy.

 

If you disagree with the Policy, please do not use the CAIAGLOBAL HR applications. CAIAGLOBAL complies with the provisions of the European General Data Protection Regulation ("GDPR"). For purposes of Article 14(2) of the GDPR.

 

CAIAGLOBAL HR applications do not automatically collect information from users. Users voluntarily submit information generally found in a resume and this information is provided to the individual CAIAGLOBAL HR application customers looking to hire candidates ("Hiring/Recruiter Companies").

 

To enable us to assist you in finding an appropriate job, we will gather personal information about you from your CV, our registration process, community sites and chatbot talks. This includes, but is not limited to: your name, your contact details including your personal email address, your career history. This information may include sensitive information as well (i.e., personal information specifying medical or health conditions, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership or information specifying the sex life of the individual).

 

CAIAGLOBAL HR applications may use aggregated and anonymized information to help improve and market the CAIAGLOBAL HR applications and may disclose personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

 

CAIAGLOBAL contracts with Amazon as the third-party cloud infrastructure provider and Google Firebase as identity management service provider. Amazon and Firebase are not used for any other purposes than to provide services related to the CAIAGLOBAL HR applications.

 

CAIAGLOBAL HR applications take reasonable and appropriate measures to protect personal information from loss, misuse, unauthorized access, disclosure, alteration and destruction.

 

We will retain your personal information for a minimum of two years. In some cases, for example when we have successfully placed you into a role or multiple roles with an employer or multiple employers, we may retain your personal information for up to ten years.

 

You have the right to withdraw your consent to CAIAGLOBAL HR applications processing your personal information at any time. You can download or delete your personal data via your Profile any time.

If you withdraw consent, we will continue to store the information we hold about you but will not process this information.
